This Privacy Policy applies only to the Ellevation website (https://ellevationeducation.com/). It does not apply to the Ellevation platform used by educators of English language learners. Ellevation Education, part of Curriculum Associates, LLC (“Ellevation,” “we,” “us”) operates the Ellevation website (“Website”). We are committed to protecting the privacy of your personal information, and we have provided this policy to inform our Website visitors (“you,” “your”), of the types of information we collect through our Website, and the ways in which we will use, disclose and protect it. This Privacy Policy is incorporated into and part of our Terms of Use https://ellevationeducation.com/legal-notices.

By accessing or using this Website, you agree to the terms of this Privacy Policy. 

Ellevation operates this Website from the United States. If you are located outside the United States, the information you provide to us is transmitted and processed in the United States, and will be protected subject to this Privacy Policy and applicable laws, which may not be as protective as the laws in your country. By visiting this Website, you agree to this.

Information You Provide

When you visit our Website, you may choose to provide us with your email address in order to subscribe to email updates about Ellevation, request a product demonstration, in which case we will ask you to provide us with your first and last name, email address, phone number, school district, state and job title in order to manage your request. In addition, if you wish to comment on one of our blog posts, we will ask you to provide your first name and email address, along with your comment, so that we may provide you with attribution and contact you if we have questions about your comment. If you chat with Ellevation Bot, our website’s AI-driven chat service, then we will use that information in support of your specific request and your future service needs.  We may also use this information for sales and marketing purposes. If you provide us with your email address, we may attempt to contact you at that address regarding quote requests. We may also send you periodic emails about our products and our company.

If you apply for a job with us through our Careers portal, you will be asked to provide your full name, address, phone number, employment eligibility and desired salary, as well as a cover letter and resume. This information is only used to assess your fit for the role for which you are applying.

A Note About Users Under Age 18

Our Website is intended for a general audience, and not for children under the age of 18. We do not knowingly collect information from users under the age of 18. Should we learn that we have inadvertently collected personal information from children under the age of 18, we will take steps to promptly delete it as necessary.

Information We Collect Automatically

When you visit our Website, our servers automatically record information sent from your browser (“Log Data”). Log Data may include information such as your computer’s Internet Protocol (“IP”) address, browser type and machine model, pages of the Website that you visit, the time spent on those pages, the referring URL, and access times and dates. We use this information to monitor, analyze use of and administer the Website, and to better tailor it to your needs. 

As you navigate through and interact with the Ellevation Website, including through interactions with Ellevation Bot, we may use automatic data collection technologies to collect certain information about your equipment, browsing actions, and patterns including, but not limited to, usage details, IP addresses, and other information. This information helps us to improve the Ellevation website and to deliver a better and more informative experience. The technologies we use for this automatic data collection may include cookies.

Third-Party Website Tracking

We do not honor “do not track” signals transmitted by web browsers.

In addition, if you submit your email address to Ellevation through a form connected to region- or product-specific marketing campaigns on our website or through the Ellevation Bot, a pseudonymized hash of your email address may be generated in order to serve targeted advertising to other devices connected to you (via cross-device tracking). Ellevation will provide a notice on our website next to any such form or within the Ellevation Bot interface if your email address will be processed by Service Providers in this manner.

We do not sell or rent personally identifiable information. 

We use and disclose your personal information only for the purposes described above and as follows:

  • To investigate a suspected violation of our Terms of Use, suspected fraud or other unlawful activity;
  • As may be required by law or by a court order, in which case, where legally permissible, we shall attempt to notify you and work with you to seek to limit the scope of the required disclosure;
  • To our third party service partners to permit them to provide features and services on our behalf (see Third Party Service Providers section below);

If you have provided us with your information in order to receive information about our products or to subscribe to email updates, we may send you Ellevation marketing email messages. Data Retention

We may retain information you provide for as long as is necessary to fulfill the purposes as described in this Privacy Policy, or as otherwise permissible by law. 

Security

We are ISO 27002 compliant, an internationally recognized set of information security standards. As such, security measures to maintain the confidentiality, security, and integrity of the information you provide to us have been deployed. These security measures, both technical and procedural, are continuously being monitored, tested, evaluated, and improved. We deploy commercially reasonable security precautions intended to protect against unauthorized access to any of this information. We store data in secure server and cloud-based environments that use firewalls, VPNs, event logging, and other industry-standard protections in an effort to monitor and prevent access from outside intruders. We also encrypt the data in transit, require unique account credentials, and limit data access. Not all security risks are reasonably foreseeable, however, and Ellevation is not responsible for the consequences of security incidents that are not reasonably foreseeable and not reasonably within its control.

Our Website contains links to third party social networking websites. If you click on a third party link, you will be directed to that third party’s website. Inclusion of a link on our website does not represent an endorsement of that website, and we do not control any aspect of those third party websites. Those websites have their own privacy policies and terms of use, and we encourage you to read them. 

Social Network Features

Within the “Blog” section of the Website, you may read, comment on, and share our blog posts. Any comments you post in this area may be read, shared, and used by others. You may also log onto third party social networking websites via social network sharing widgets to share, comment, or recommend blog posts. The social network sharing widgets may provide information to their associated social networks or third parties about your interactions with our Website pages that you visit, even if you do not click on or otherwise interact with the plug-in or widget. Information is transmitted from your browser and may include an identifier assigned by the social network or third party, information about your browser type, operating system, device type, IP address, and the URL of the web page where widget appears. Updates To This Privacy Policy

We review this privacy policy on an annual basis and makes updates from time to time, for example, to reflect changes in legal requirements and to provide more clarity regarding our practices. When we make any changes, we will alert you by updating the “last updated” date at the top of this Privacy Policy indicating when it was last revised. Changes will become effective when posted. You are responsible for periodically visiting the Ellevation Website and this privacy policy to check for any changes. If you do not agree to changes to this Privacy Policy, you may not continue to use this Website.

State Data Privacy Law Addendum to Corporate Website Privacy Policy

State law provides residents of California and other certain states, including Colorado, Connecticut, Utah and Virginia, with the additional rights listed below.  

Right to Know 

You have the right to request that we disclose certain information to you about our collection of your personal information.  Upon our receipt of your verified request, we will provide you with the following:

We do not sell any information that identifies you personally like your name or phone number. However, when you visit the Ellevation Website, we store cookies on your browser to collect information to make the Ellevation Website work as you expect it to and to provide you a more personalized web experience, and we do work with advertising partners who use cookies and device identifiers as described in this Ellevation Website Privacy Policy to show ads that are targeted to your interests. With respect to personal information collected by Ellevation in connection with a form you completed which was related to region- or product-specific marketing campaigns on our website or through the Ellevation Bot, you can subsequently opt out of Ellevation’s future use and collection of the personal information you have provided to us through those channels by submitting a request here: you may send an email to dataprivacy@ellevationeducation.com.

Right to Limit Use and Disclosure of Sensitive Personal Information

Curriculum Associates does not collect or share your Sensitive Personal Information, as that term is defined under Section 1798.140 of the California Privacy Rights Act.

Right to Delete

You have the right at any time to request that we delete your personal information. There are a number of exceptions to this right, however, and if one of those exceptions is applicable we will not delete your data in response to your request.  We will provide you with an explanation as to why we cannot delete your data in response to a request.

Right to Correct Inaccurate Personal Information.

You have the right to request that we correct inaccurate personal information about you, taking into account the nature of the personal information and the purposes for Ellevation’s processing of that information.

Right to Appeal A Refusal to Take Action. Certain states provide its residents with the rights to appeal a refusal by Curriculum Associates to take action with respect to requests protected under applicable law. We will inform you of our decision to not take action, along with an explanation of that determination. You may appeal our refusal to take action within forty-five (45) days of our decision, by either emailing dataprivacy@ellevationeducation.com or by calling the following toll-free number: 1-800-225-0248. You may also contact the attorney general in your state of residence if you have concerns about the results of the appeal. In connection with any consumer request, we may request that you provide additional information reasonably necessary to authenticate your request.

Right to Non-Discrimination.

We will not take any adverse actions against you for exercising your rights under the CPRA or applicable laws.

As described in our Privacy Policy, we engage certain trusted third parties to perform functions and provide services to us, including hosting and maintenance, error monitoring, debugging, performance monitoring, web site optimization, database storage and management, and direct marketing campaigns. We use third parties for certain marketing-analytics purposes. We may share your personally identifiable information with these third parties, but only to the extent necessary to perform these functions and provide such services. We also require these third parties to maintain the privacy and security of the personally identifiable information they process on our behalf.

Policy Review.

This CPRA Policy is reviewed and updated periodically as described in the “Updates to This Privacy Policy” section of our Privacy Policy.

Retention of Information.

We will retain your personal information only as long as is reasonably necessary for the operation of our business and as otherwise required for legal compliance purposes.

How to Exercise Your Rights.

Residents of California, Colorado, Connecticut, Utah, and Virginia may exercise their rights under applicable state laws by either email to dataprivacy@ellevationeducation.com or by calling the following toll-free number: 1-800-225-0248. Depending on the nature of your request, we may have to verify your identity prior to responding to it. We will do our best to respond to your request as soon as we can.  If we are not able to respond to your request within 45 days, we will let you know that we may require additional time, up to 90 total days. We are not able to respond to more than one “Right to Know” request from a consumer in any 12-month period.

Nevada Residents.  We are required under Nevada law to notify you that we do not sell consumer personal information.
